Event Terms and Conditions (Event Policy)

1. Terms

Event means any organised or coordinated activity that is facilitated both online or offline (face to face) for the purpose of providing information, education, social connection, or another purpose. Events include but are not limited to: all educational programs, recovery programs, webinars, workshops, seminars, forums, round tables, meetings, gatherings, and creative activities.

Content means something that is expressed through some medium, as speech, writing, or any of the various arts and includes but is not limited to written works, speech, audios, visuals, audio-visuals, images, graphics, models, processes, gaming, apps, etc. For the purpose of this Event Terms and Conditions (Event Policy), Resources also means Content.

2. Intellectual Property

Unless otherwise indicated, Chi Balance Pty Ltd (also trading as Workshops 4 Life and Positive Empowerment Group) (“the Company”) owns copyright for the Content presented in any of our events.

The Content of all events, including communications that relate to the event, must never be recorded or reproduced without the express written permission of the Company. In the case of third party providers, the Company will seek pre-approval from the intellectual property owner prior to any decision being made about such reproductions or recordings.

All Content, unless otherwise stated, remains copyright of the Company and must not be distributed to any third party at any time or in any form without written permission from the Company. The Content must not be modified or republished in any way without the prior written consent of the Company.

If you seek to reproduce or otherwise use the Content in any way, it is your responsibility to obtain approval for such use where necessary. Any breach of copyright, including recording the presentation or any unauthorised use of the material may lead to legal action.

3.Learning Outcomes

Although we work diligently to provide high quality material, content and resources as part of our services, the Company is not liable for any learning outcomes that may not have or did not entirely meet expectations.

4.  Disclaimer

The information contained in the Multimedia Content (video, audio, pdfs, PowerPoint presentations and other media) posted represents the views and opinions of the original creators of such multimedia Content and does not necessarily represent the views or opinions of the Company. The mere appearance of Content does not constitute an endorsement by the Company or its affiliates of such Content.

Content including all resources, has been made available for informational and educational purposes only. The Company does not make any representation or warranties with respect to the accuracy, applicability, fitness, or completeness of the Content. The Company does not warrant the performance, effectiveness or applicability of any websites or other sites or applications listed or linked to in any Content.

Event and website related Content is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read, seen or heard in a presentation, on a website, other digital platform, or within any multimedia content.

The Company hereby disclaims any and all liability to any party for any direct, indirect, implied, punitive, special, incidental or other consequential damages arising directly or indirectly from any use of the Content, which is provided as is, and without warranties.

5. Links to Third Party Sites

Content may contain links to external websites, applications, or other digital platforms which the Company has no control. The Company makes no representations about the accuracy of information contained on those sites. We are not liable for the content on those digital sites.

6. Registrations and Consent

By registering for an Event, consent is given for application details to be used to inform and update you on the event including event changes and any follow-up communication including occasional emails to inform you about upcoming events or new products and/or services. You may unsubscribe from these emails at any time by clicking unsubscribe within the email or replying with ‘Unsubscribe’ in the subject line.

7. Zoom Events and Your Privacy

The Company often uses Zoom for online Events. General information and etiquette for an online zoom event:

For all Zoom related Events or other zoom contact, attendees have the ability to switch their camera on or off. When speaking, it is preferred that the attendees camera is on, so that the facilitator, moderator or host can see who they are communicating with.

If a participant is under the age of 18 years old and wishes to have their camera on, it is the participant’s responsibility to obtain parent/guardian permission and/or ensure the parent/guardian is present at the time of the Zoom Event.

While other attendees are speaking, other participants are encouraged to mute their microphone to avoid excess sound.

There will be Company moderators in Zoom events to ensure all participants are engaging in safe and appropriate behaviour.

Using the application

There will be a waiting room and a passcode to ensure only the registered attendees are granted access. Zoom meeting access will be sent only to registered attendees.

Private chat between participants, renaming of personal IDs and attendee screen annotation will be disabled for all registered attendees.

All The Company Zoom 'chats' will not be recorded but the Event (for example, a presentation) will be recorded. You will have the option to refuse participation in recording by selecting the relevant option during the zoom meeting when recording is started.

Zoom’s "Report a user" function will be used for any inappropriate behaviour. The attendee will be reported to the Zoom’s Trust & Safety team, who will review any potential misuse of the platform and take appropriate action.

If attendees continue to behave inappropriately, they will be removed from the Zoom by the host/moderator and will not be permitted to re-enter the Event.

The Company is committed to protecting your privacy and will ensure that personal information it collects is managed in accordance with the Information Privacy Act 2009 (Qld).

8. Event Cancellation

If for any reason the Event is required to be cancelled by The Company, a notification email will be sent as soon as possible, and paid participants will be refunded in full.

9. Refunds

The Company will issue refunds when:

  • a program has been cancelled by the Company or the contracted provider for the Company;

  • the participant or the client provides written notice prior to the commencement date of the program;

  • the participant or client is unable to attend due to extended hospitalisation/illness;

  • exceptional circumstances prevent you from attending;

  • where the Company offers a 100% satisfaction guarantee.

 

100% Satisfaction Guarantee

Chi Balance Pty Ltd (the Company) sometimes offer a 100% satisfaction guarantee on programs. This guarantee allows clients who feel as though they have not received the quality of the service they expected, or are unhappy in any way, to apply for a full refund.

The Satisfaction Guarantee includes the right of the Company to first attempt to correct the issue. If the client is still not happy, the Company will provide a 100% refund. Refer to Complaints Policy and Process.

It is the responsibility of the participant to ensure that they have enrolled in the correct event (program, workshop, etc.).

Refund Exceptions

The Company will not issue refunds for:

  • changes in participants work hours

  • inconvenience of travel to class

  • moving interstate

  • job change or retrenchment

  • participants who leave prior to completing a course or module

  • where the ticket states that it is a non-refundable ticket

 

Requests for refunds must be submitted in writing by email to connect@chibalance.au using the Refund Application Form.

10.  Customer Complaints

Your satisfaction is important to us. For any grievances or complaints, please send an email with all relevant details to connect@chibalance.au. Based on the complaint, one of our team members may contact you directly by phone or send you a form to complete. Our team will make every effort to resolve your issue as quickly as possible and ensure that you are satisfied and treated with respect at all times through the process.
